Anyway, the upside to all this is that we've sold more JPBC t-shirts over the weekend than we probably would have over the next two years if Hershey hadn't taken any action. I'm still trying to get my hands on a copy of the letter they sent to Cafe Press, and I'll let you know when I do.
I've been in contact with a lawyer, and have an email in to the Comic Book Legal Defense Fund, so hopefully I should be hearing something one way or another. Chris Koeberle sent in a link to an interesting article concerning Trademark Parody Law, which essentially concludes that this is a gray area of the law that hasn't really been addressed properly, except on a case-by-case basis. There are a few cases that come close to this one mentioned in the article, most notably (in my mind, anyway) the Garbage Pail Kids one, which is an example of Commercial Parody that received First Amendment protection. More news as I get it.
